What Awaab's Law requires

Named after two-year-old Awaab Ishak, who died from prolonged mould exposure in his home in Rochdale in 2020. The law imposes fixed timescales on social housing providers for the first time.

Phase 1 — in force

In force since 27 October 2025. This guidance applies until 29 November 2026. Covers the most serious hazards — damp, mould, and conditions posing an imminent risk to health.

  • Within 10 working days of becoming aware: investigate a potential significant hazard
  • Within 3 working days of the investigation concluding: give the tenant a written summary of the findings
  • Within 5 working days of the investigation concluding: carry out the relevant safety work, where a significant hazard is found
  • Emergency hazards: investigate and make safe within 24 hours of becoming aware
  • Within 5 working days of the investigation concluding: begin supplementary preventative work to stop the hazard recurring — or as soon as reasonably practicable, and within 12 weeks
  • Suitable alternative accommodation, at your expense, where safety work cannot be completed in the timeframes
  • Keep the tenant updated throughout, and tell them how to stay safe if the home is not vacated
  • The clock runs from when you become aware of the hazard, however it reaches you — not from a written complaint

Phase 2 — coming

From 30 November 2026 the significant-hazard timescales extend to a named set of hazards beyond damp and mould. The regulations and landlord guidance are published.

  • Excess cold and excess heat
  • Falls — on the level, on stairs, and between levels
  • Structural collapse, fire and explosions, electrical hazards
  • Domestic hygiene — including personal hygiene and food safety
  • Same investigate → report → remedy structure as Phase 1, applied across most of the repairs service
  • Systems must be ready before it commences — retrofitting after is too late

What exactly does Awaab's Law require?

Awaab's Law places statutory duties on social landlords to investigate reported hazards and complete remedial work within fixed timescales, with shorter windows where a hazard presents a significant risk to health. What counts as a reported hazard?

Any report from a resident, an officer or an inspection that indicates damp, mould or another prescribed hazard. The point of failure for most providers is a hazard logged as a routine repair — so repair descriptions are read for hazard indicators and routed into the statutory workflow rather than a general queue.

How do we evidence compliance if challenged?

Every case carries a timestamped audit trail covering the report, investigation, decision, works and follow-up. Portfolio reporting shows open hazards, cases at risk of breach and completed remediation without manual collation.

What happens when a deadline is about to be missed?

The case escalates before the deadline, not after, so a manager can intervene while action is still possible within time. Missed deadlines are recorded rather than quietly absorbed.

Do we need to replace our whole housing system to comply?
